What Should I Do After an Accident?

Being in a serious auto accident is never something you expect. It can be shocking and make it hard to think clearly after an accident. This is common because your adrenaline has kicked in and is surging throughout your entire body. We put together these tips (keep them handy) so you know what to do immediately following an accident:

  • First and most important, seek any medical treatment you may need!
  • Take pictures (and video if possible) of the accident scene. If you have your cell phone with you this is a great to use for this. Don’t forget to take pictures of any injuries sustained as well.
  • Write down the other driver’s name, contact information, driver’s license, and insurance company information.
  • Write down contact information for any witnesses (names and phone numbers).
  • DO NOT give your opinions about what happened or what you think you saw during the accident. Share only the facts when speaking to police. Talk with an attorney immediately.

Statute of limitations

In Washington, you have three years from the date of your accident to file a lawsuit against the at fault party. This is called the statute of limitations. This is one of the most important reasons we recommend you contact an experienced attorney as soon as you can following your accident. There are certain exceptions to the statute of limitations where it can be “tolled” (for example, with minors the statute of limitations does not start until their 18th birthday), but it is best to talk with an experienced personal injury attorney as soon as possible to discuss the details of your case.

Proving Liability

Before you are awarded any monetary losses from injuries you sustained in your accident, you will need to prove that the other party’s negligence caused the accident. You do not have to take on this burden all alone. You will be required to gather evidence against the other party who hit you in order to prove liability. It will also be required that you establish “breach of duty of care” and how this relates to the injuries you sustained in the accident. Contact an experienced Redmond personal injury attorney immediately. An attorney can gather evidence against the other party, contact eyewitnesses to the accident, and organize expert medical testimony if your case goes to trial. We want you to be able to focus on healing from your injuries, so let us take on this burden for you while you recover.

Seek Medical Treatment Until You Are Healed

If you do not seek treatment right away, the insurance company may not think you have any serious injuries. Be sure to see a trained medical professional who can give you an exam and document any injuries immediately following your accident. If you are not diligent about treating for your injuries, the insurance company will try to use that against you when filing a claim. Be sure to go to all of your scheduled doctor appointments. If you can’t make an appointment, then reschedule right away. Make sure that you are completely healed and recovered before discussing any settlement offers. A settlement payout from the insurance company is final, which means that if you experience any medical issues down the road and you have already settled, there will be no more money from the insurance company to cover these additional costs. Take your time to seek treatment and heal fully from your injuries.
