What Should I Do After an Accident?

Being hit in an accident is shocking and unexpected. It can be hard to focus and think clearly due to the adrenaline running through your body. It is a good idea to keep these tips handy so you know what to do immediately following an accident:

  • Seek the medical care you need first!
  • Use your cell phone to take photos and videos of the scene of the accident. Get photos of any injuries sustained as well.
  • Get the other driver’s name, contact information, driver’s license, and insurance company information.
  • Record contact information for any witnesses (names and phone numbers).
  • State only the facts when talking to the police. DO NOT give your opinions about what happened or what you think you saw. Speak with an attorney immediately.

Seek Medical Treatment Until You Are Healed

You will want a trained medical professional to give you an exam and document any injuries immediately following your accident. If you do not seek treatment right away, the insurance company may think that you do not have any serious injuries. Insurance companies are notorious for using this against injury victims when filing a claim. Be sure to go to all of your scheduled doctor appointments. If you can’t make an appointment, then reschedule right away. Make sure that you are completely healed and recovered before discussing any settlement offers. A settlement payout from the insurance company is final. If you have medical issues down the road and you have already settled, there will be no more money from the insurance company to cover these additional costs.

Statute of limitations

There is a set time limit in Washington state on how long you have to take your accident case to court. This is called a statute of limitations. In Washington, you have three years from the date of your accident to file a lawsuit against the at-fault party. This is why it is best to contact an attorney as soon as you can following your accident. There are some exceptions in which the statute of limitations can be “tolled” (for example, with minors the statute of limitations does not start until their 18th birthday), but it is best to talk with an experienced personal injury attorney as soon as possible to discuss the details of your case.

Proving Liability

In order to prove liability, you will need to gather evidence against the other party who hit you and establish “breach of duty of care” to you and how this relates to your injuries from the accident. Before you can be awarded any monetary losses from injuries sustained in an accident, you will need to prove that the other party’s negligence caused the accident. You do not have to take on this burden all alone. Contact an experienced personal injury attorney in Kirkland who can help contact eyewitnesses to the accident, gather evidence against the other party, and organize expert medical testimony if your case goes to trial. Let us take on this burden for you while you so you can heal and recover from your injuries.
